No responsibility is assumed by Barko Hydraulics, LLC (the "Sponsor") for lost, late, misdirected, illegible, or mutilated entries or for any computer, online, telephone or technical malfunctions that may occur. Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address. All entries become the property of Barko Hydraulics, LLC and will not be returned to entrant.

Winner Selection: Winners will be selected in a random drawing. Winner will be notified via US mail, email and/or telephone. Odds of winning depend on the number of eligible entries received. All prize drawings will be conducted under the supervision of Barko Hydraulics, LLC. whose decisions are final.

No substitution or transfer of prizes permitted except that Barko Hydraulics, LLC reserves the right to substitute a prize of equal or greater value if an advertised prize is unavailable.

Eligibility: This Sweepstakes is open to legal residents of the United States who are eighteen (18) years or older at the time of entry and have a valid logging, construction, land clearing, land preparation or scrap application. A valid logging, construction, land clearing, land preparation or scrap application is an application that uses knuckleboom loaders, material handlers, industrial tractors or industrial crawlers. Void where prohibited or restricted by law. Employees of Barko Hydraulics, LLC, their respective parents, their affiliates, subsidiaries, advertising and promotional agencies and the immediate family members of each are not eligible.

Sweepstakes entrants agree to abide by the terms of these Official Rules and by the decisions of Barko Hydraulics, LLC which are final on all matters pertaining to Sweepstakes. This Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply. All taxes, fees, and surcharges on prize packages are the sole responsibility of the prize winners. Prize winners will be notified within seven (7) days after drawing date. Prize winners will be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days following attempted notification. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner.

Entrants grant to Barko Hydraulics, LLC the right to use and publish their proper name and state online and in print, or any other media, in connection with the Sweepstakes. Acceptance of a prize constitutes permission for Barko Hydraulics, LLC and its advertising and promotional agencies to use winners' names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants release and hold harmless Barko Hydraulics, LLC, their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Sweepstakes or any prize won. Restrictions, conditions, and limitations apply. Barko Hydraulics, LLC will not replace any lost or stolen or prize items once in the winner's possession. Winner further acknowledges that Barko Hydraulics, LLC is not responsible or liable for any warranty, representation, or guarantee express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness.

Barko Hydraulics, LLC reserves the right to use any and all information related to the Sweepstakes, including information on entrants obtained through the Sweepstakes, for marketing purposes or any other purpose, unless prohibited by law.

By entering this Sweepstakes, you agree to be bound by these Official Rules. The Official Rules will be posted at the Sweepstakes Site throughout. Entrants further agree to be bound by the decisions of the judges which shall be final and binding in all respects. Barko Hydraulics, LLC reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the game or website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Barko Hydraulics, LLC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Barko Hydraulics, LLC is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Barko Hydraulics, LLC which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Barko Hydraulics, LLC reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes.
